said John Yelverton bearing date the twenty fourth day of March in the Year of our Lord one thousand seven hundred and sixty did amongst several other things in the said Will contained Give and Bequeath unto his said grandson the above named Abajah Yelverton all this said messuage or tenament above mentioned and described as in and by the said Will and Testament being had and may more fully and at large appear together with all and singular the houses edifices buildings orchards gardens lands meadows pastures feeding woods underwoods waters water courses easements profits mortgages Hereditaments and appurtenances as thereunto belonging or in any wise appertaining and the revision and revisions remainder and remainders thereof and all and singular the said premises above mentioned end of every part and parcel the appurtenances and also all the estate right title and rights entitles ??? ??? interest claim and demand whatsoever of them and the said Abajah Yelverton and Margaret his wife and of in and all and singular the said premises above mentioned and of and to every part and parcel thereof with the appurtenances unto the said Thomas Ellison his heirs and assigns to the only proper use benefit and behoof of him the said Thomas Ellison his heirs and assigns forever and the said Abajah Yelverton for himself and his heirs and assigns doth covenant and grant to and with the said Thomas Ellison his heirs and assigns that the said above granted and released lands and premises above mentioned with the appurtenances are free and clear of and from all manner of encumbrances whatsoever claiming or to claim by from or under him them or any of them and further that the said Abajah Yelverton for himself and his heirs and assigns the above granted and released lands and premisses and every part and parcel thereof with the unto the said Thomas Ellison his heirs and assigns against him the said Abajah Yelverton for himself and his heirs and assigns and against all and all manner of persons whatsoever lawfully claiming the same or any part or parcel thereof shall and will warrant and forever defend by these presents provided always and it is the rue intent and meaning of these present and of the parties to the same that is the said Abajah Yelverton his heirs executors or assigns the just and full sum of two hundred and fifty pounds current money of the Province of Newyork at the day and time xxxx and n such manner as by the condition of the above mentioned bond or obligation is limmitted with the interest for the same at seven per-cent and that without any deduction or abatement for or by reason of any taxes assessments or other impositions whatsoever then and thence forth these presents and every article clause matter and thing herein before contained and the Estate here by granted together with the said above mentioned bond or obligation shall cease determine and be utterly void and of no effect as if the same had never been made anything in these presents contained to the contrary not withstanding and the said Abajah Yelverton for himself and his heirs executors and admtrs do covenant promise grant and agree to and with the said Thomas Ellison his heirs admtrs and assigns that he the said Abajah Yelverton for himself and his heirs executors admtrs or assigns or some os one of them shall and will well and truly pay or cause to be paid unto the said Thomas Ellison his certain attorney Executors admtrs or assigns the said sum of two hundred and fifty pounds at such day and time and in such manner and form as tin the above proviso or condition of the bond mentioned bond or obligation is hereinbefore limmitted and appointed with the interest for the same without and deduction as aforesaid awording to the true intent and meaning of these presents and also that the said messuage or tenement lands and premisses above mentioned and every part and parcel thereof with the appurtenances now are and at all times after default shall be made in performance of the proviso or condition aforesaid shall remain and be free and clear of all former and other gifts grants bargains sales leases releases mortgages indentures dowers judgments extents and all other charges and incumbrances whatsoever had committed done or suffered or th be had made committed cone or suffered by the Abajah Yelverton his heirs or assigns or any other person or persons claiming by from or under him them or any of them in Witness whereof the parties to these presents heave hereunto interchangeably set heir hands and seal the day and year first above written
