I John Bard Son of the State once City of New york Physician do hereby make this my last will and Testament in manner and form following that is to say I give and Bequeath all my ... real and personal, and all my book debts to my Daughter Dinah magdalen muirson and I do hereby constitute and appoint her my sole Executor so far as relates to her particular part in this my will, and hope no other apology will be necessary to my other children all of whome I equally love for this seeming Partiality but that I know she is the most in need of it and the Property I Expect to leave would be of ... w/o to Either if divided among them and I also give to my said Daughter Magdalen the right and power to dispose of the property I leave or that part which will fall to her w/o which she may ... ... of in any many she thinks proper and here I recommend to my said Daughter to be advised by my Executors here after mentioned, but not to be ... by them, with respect to the disposal of any part of the property I leave at any time after my Discant [sic] - and I Further will that after an Estimate be made of the Value of what I shall ... of in Bonds notes and Good debts if they should be found to Exceed one thousand pounds current money of New york exclusive of my household Furniture which I hereby particularly bequeath to my said Daughter Muirson that all such overplus [sic] shall be divided share and share alike between my son John Bard and Mary his wife and their Heirs, my son Doctor Sam Bard and Mary his wife and their heirs, my son in law Nathan Pendleton and Susannah his wife and their heirs and to my Daughter Anne Pierce which may remain after my Debts are paid, and the bequeath ... .. may Magdalen Muirson fulfilled and further will and declare that all my Title to lands in Vermount [sic] or any Indemnification which may be hereafter obtained for w' if any I will that it may be divided among my surviving children and their Heirs in five equal shares first to divided to be by them possessed, and I further will and direct that all the lands which may belong to me on that Score or in the ... of ...to be sold and the money arising therefrom to be divided into five equal shares and Supervisd by them in the form above mentioned Jan 23 1795

Remembered that on the Twenty second day of May in the Year of our Lord one thousand seven hundred and ninety nine personally came and appeared before me Peter Agilvie Judge of the Court of Probates of the state of New York Maiselus M Van Gieson and being duly sworn on his oath declared that he did see John Bard senior sign and seal the foregoing written Instrument purporting to be the last will and Testa of the said John senior ... ... The Twentythird day of January in the year of our Lord one thousand seven hundred and ninety five and heard him publish and declare the same as and for his last will and Testament that at the time thereof ... said John Bard senior was of sound disposing mind and memory to the best of the knowledge and belief of him the Deponent and that his name subscribed to the said will is of his own proper hand willing which he subscribed as a witness thereto in the Testators presence and that he the Deponent likewise saw David Steward Graig and Shael DVeause the other witness to the said will severally subscribe their names as witnesses thereto in the Testators presence and in the presence of Each other
